Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") form a legally binding agreement between you and LEAPR ("LEAPR", "we", "us", "our"), operated by Dawid Ratajczak. By ticking the acceptance checkbox at registration and by using the LEAPR mobile application or website at leapr.app (together, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, do not create an account or use the Service.

2. Age requirement

You must be at least 16 years old to use LEAPR.

By creating an account, you confirm that you are at least 16 years old. If you are under 16, you must not create an account or use the Service.

If we discover that a user is under 16, we will immediately terminate their account and delete their data without notice.

3. Account registration

To access most features of the Service, you must create an account using your email address and password, or by authenticating via Google or Apple. You are responsible for:

• Providing accurate and truthful registration information.
• Keeping your login credentials secure and confidential.
• All activity that occurs under your account, whether or not authorized by you.

Notify us immediately at [email protected] if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain the security of your credentials.

4. What LEAPR is and is not

4.1 What LEAPR is

LEAPR is a self-improvement and educational application. It presents optional, voluntary challenges and prompts intended to help users practice social interactions, build confidence, and develop comfort in everyday social situations. It is designed for personal development and entertainment.

4.2 What LEAPR is not

LEAPR is not any of the following and must not be treated as such:

• A medical device.
• A therapeutic service.
• Psychological counselling or psychiatric treatment.
• Any form of professional healthcare or clinical service.
• A crisis intervention service.
• A substitute for professional medical or psychological care of any kind.

The content of the App — including any wellbeing tracking, progress metrics, challenge prompts, and in-app debriefs — is provided for general informational and educational purposes only. It does not constitute, and is not a substitute for, professional medical or psychological advice, diagnosis, or treatment. References to psychological or behavioral science concepts within the App are for informational context only.

5. Voluntary participation in challenges

All challenges presented by LEAPR are entirely optional.

Nothing in the App requires, instructs, pressures, or compels you to take any specific action. Each challenge is a voluntary suggestion. The App presents possibilities; it does not direct your conduct.

Whether, when, where, how, and to what extent you attempt any challenge is exclusively your own free decision, made using your own independent judgement about what is safe, lawful, appropriate, and suitable for:

• Your individual physical and mental health circumstances.
• Your personal environment and the specific social context in which you find yourself.
• The rights, safety, and wellbeing of other people.
• Applicable laws and regulations.

LEAPR is not present during the performance of any challenge, has no knowledge of the conditions in which you choose to act, and has no ability to monitor, supervise, or intervene in your real-world activities.

You are always free to skip any challenge, modify it, pause your use of the App, or stop entirely at any time and for any reason.

6. Assumption of risk

By using the Service and choosing to attempt any challenge, you acknowledge and voluntarily accept the following:

6.1

Real-world social interactions involve inherent, unpredictable, and uncontrollable risks, including without limitation:

• Physical contact with or physical injury caused by third parties acting independently.
• Emotional discomfort, embarrassment, anxiety, rejection, or distress.
• Unexpected, hostile, or aggressive reactions from other people.
• Unwanted public attention or exposure.
• Social or reputational consequences.
• Any other emotional, social, physical, or psychological consequence.

6.2

You have chosen to use LEAPR freely and voluntarily. You make any decision to attempt a challenge freely and voluntarily, using your own independent judgement. You knowingly, voluntarily, and expressly assume all risks arising from your independent decision to act on any challenge, suggestion, or prompt presented by the App, regardless of whether those risks were foreseeable or unforeseeable at the time you acted.

6.3

You are solely and entirely responsible for your own conduct, your own safety, and all consequences of your actions when attempting any challenge. This includes your responsibility to ensure that your actions:

• Are lawful.
• Respect the rights, safety, dignity, and wellbeing of others.
• Are appropriate for your physical and mental state at the time.

6.4

LEAPR makes no warranty, guarantee, or representation that using the Service or completing challenges will result in any particular outcome, including any improvement in confidence, social skills, mental health, or any other personal attribute.

7. Limitation of liability

7.1 General exclusion

To the maximum extent permitted by mandatory applicable law, LEAPR, its founders, directors, employees, officers, and partners shall not be liable for any:

• (a) Physical injury, death, or bodily harm arising from your participation in any challenge or any action taken by a third party in connection with a challenge;
• (b) Psychological harm, emotional distress, embarrassment, reputational damage, or social consequences arising from your participation in any challenge;
• (c) Indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including loss of data, loss of opportunity, or financial loss, arising out of or related to your use of, or inability to use, the Service;
• (d) Actions or omissions of third parties you interact with in the course of or following any challenge.

This limitation applies even if LEAPR has been advised of the possibility of such damages and regardless of the legal theory under which liability is claimed (contract, tort, negligence, strict liability, or otherwise).

7.2 Non-excludable liability

Nothing in these Terms excludes, restricts, or modifies any right or liability that cannot lawfully be excluded, restricted, or modified. This includes:

• (a) Liability for death or personal injury caused directly by LEAPR's own negligence;
• (b) Liability for fraud or fraudulent misrepresentation made by LEAPR;
• (c) Statutory consumer rights under Polish law (including the ustawa o prawach konsumenta) and applicable EU consumer protection law that cannot be contractually excluded or modified;
• (d) Any other non-excludable liability under mandatory applicable Polish or EU law.

7.3 Aggregate liability cap

To the extent permitted by law, LEAPR's total aggregate liability to you under or in connection with these Terms shall not exceed the greater of: (i) the total subscription fees paid by you to LEAPR in the twelve months immediately preceding the event giving rise to the claim; or (ii) EUR 50.

8. Indemnification

To the extent permitted by mandatory Polish and EU consumer protection law, you agree to indemnify, defend, and hold harmless LEAPR and its founders, directors, employees, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• (a) Your conduct in connection with any challenge, including claims brought by third parties who were affected by your actions;
• (b) Your breach of any provision of these Terms;
• (c) Your violation of any applicable law or regulation;
• (d) Your violation of the rights of any third party.

9. Acceptable use

You agree not to:

• Use the Service if you are under 16 years of age.
• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Attempt to gain unauthorized access to any part of the Service, its servers, or connected systems.
• Use automated tools, bots, scrapers, or scripts to access or interact with the Service without our written permission.
• Reverse engineer, decompile, or disassemble any part of the App.
• Impersonate any person, company, or entity.
• Upload or transmit any viruses, malware, or malicious code.
• Use the Service in a way that could damage, disable, or impair the Service or interfere with other users' access.

We reserve the right to suspend or terminate accounts that breach these rules, and to report unlawful activity to the appropriate authorities.

10. Intellectual property

All content within the Service — including but not limited to challenges, challenge descriptions, text, graphics, design, user interface elements, software, and any other materials — is owned by or licensed to LEAPR and is protected by Polish and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, publicly display, create derivative works from, or commercially exploit any part of the Service without our prior written permission.

Your own reflections, ratings, and content that you input within the App remain yours. By inputting them, you grant LEAPR a limited, non-exclusive, royalty-free license to store, process, and use this content solely for the purpose of providing the Service to you. We do not claim ownership of your personal inputs.

11. Subscriptions and billing

11.1 Free tier

LEAPR offers a permanent free tier with a defined set of features. No payment is required to access the free tier.

11.2 LEAPR Pro subscription

LEAPR Pro unlocks the full feature set and is available as a recurring monthly or annual subscription. Current pricing is displayed within the App at the point of purchase and on our website. All prices include applicable VAT.

11.3 Auto-renewal

Subscriptions auto-renew at the end of each billing period (monthly or annual) at the then-current subscription price, unless you cancel before the renewal date. By subscribing, you authorize LEAPR (or our payment processors — Apple, Google, or RevenueCat) to charge your designated payment method on a recurring basis until you cancel. You will receive advance notice before any price change takes effect on your subscription.

11.4 Cancellation

You may cancel your subscription at any time through:

• iOS: Settings > [Your Name] > Subscriptions > LEAPR > Cancel Subscription
• Android: Google Play > Payments & Subscriptions > Subscriptions > LEAPR > Cancel

Cancellation takes effect at the end of the current billing period. You will retain access to LEAPR Pro features until that date. Deleting the App does not cancel your subscription.

11.5 Refunds

We do not offer refunds for subscription fees, except as required by mandatory applicable law. For purchases made through the Apple App Store or Google Play, refunds are handled under Apple's and Google's respective refund policies, which are outside our control.

11.6 EU and Polish consumer right of withdrawal

Under Polish consumer law (ustawa z dnia 30 maja 2014 r. o prawach konsumenta, implementing EU Directive 2011/83/EU), you have the right to withdraw from a digital service contract within 14 days of the date of purchase, without giving any reason.

Waiver of withdrawal right: If you request immediate performance of the subscription (i.e., you choose to access LEAPR Pro features before the 14-day period expires), you will be asked, at the point of purchase, to expressly acknowledge that: (a) performance of the service has begun at your request; and (b) you thereby lose your right of withdrawal with respect to the portion of the service already performed. This acknowledgement will be presented as a separate, explicit step before purchase is confirmed.

If the 14-day period expires without you having used the subscription, you may exercise your right of withdrawal by contacting [email protected] within that period.

12. Email communications

12.1 Service and transactional messages

We may send you emails that are necessary for the provision of the Service, including account confirmations, security alerts, subscription confirmations, and billing notices. These are sent on the basis of our contract with you and do not require separate consent.

12.2 Marketing communications

We will send you marketing emails (challenge tips, product updates, and promotional content) only if you have separately and voluntarily opted in by ticking the relevant checkbox at registration. This opt-in is not a condition of creating an account or using the Service.

You may withdraw your consent to marketing emails at any time by:

• Clicking the "unsubscribe" link in any marketing email; or
• Contacting [email protected].

Withdrawal of marketing consent does not affect the lawfulness of any marketing communications sent before withdrawal.

13. Push notifications

The App may request permission to send push notifications to your device, including streak reminders and re-engagement messages. Granting notification permission is optional and not required to use the Service. You may withdraw permission at any time through your device's notification settings. Withdrawing permission does not affect your account or subscription.

14. Third-party platforms and services

The Service is available through the Apple App Store and Google Play. Your use of those platforms is subject to their respective terms of service and privacy policies. Subscriptions and purchases made through those platforms are subject to Apple's and Google's terms, including their refund and billing policies, which we do not control. LEAPR is not responsible for the availability, content, or practices of any third-party platform.

15. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

Nothing in this clause affects any non-excludable statutory consumer guarantees under Polish law.

16. Account suspension and termination

By LEAPR: We may suspend or terminate your access to the Service at any time if you breach these Terms, if required by applicable law, or for legitimate operational reasons with reasonable notice. Where possible, we will notify you before termination.

By you: You may close your account at any time by using the in-app account deletion function or by emailing [email protected]. Closing your account ends your right to use the Service. Data handling on account closure is governed by our Privacy Policy.

On termination for any reason, provisions of these Terms that by their nature should survive will remain in force, including Sections 6, 7, 8, and 10.

17. Dispute resolution and governing law

17.1 Governing law

These Terms are governed by and construed in accordance with the laws of Poland, including the Polish Civil Code (Kodeks cywilny) and the Polish Consumer Rights Act (ustawa o prawach konsumenta).

17.2 Jurisdiction

For disputes arising out of or in connection with these Terms:

• Consumer users (EU/EEA residents): You may bring proceedings before the courts of your country or place of habitual residence, as required by EU consumer protection law (Rome I and Brussels I Recast Regulations), or before the courts of Poznań, Poland. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
• Business users and non-consumer users: Any dispute shall be submitted to the exclusive jurisdiction of the courts of Poznań, Poland.

17.3 Consumer rights

Nothing in these Terms diminishes or excludes any statutory rights you have as a consumer under Polish law or applicable EU consumer protection law. These rights exist independently of and in addition to any rights granted by these Terms, and cannot be waived by contract.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be severed from the remaining provisions. The remaining provisions will continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and LEAPR with respect to the Service and supersede all prior agreements and understandings.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you within the App or by email at least 14 days before the changes take effect, and we will update the "Last updated" date above. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not accept material changes, you may close your account before they take effect at no penalty.
